Acceptance of these Terms
By downloading, accessing, or using Prism, you agree to these Terms of Service. If you do not agree, do not use Prism.
Eligibility
You may use Prism only if you can form a binding agreement and comply with these Terms, applicable laws, Apple platform rules, and any age restrictions that apply to your App Store account.
License to use Prism
Jesse Rubio grants you a limited, non-exclusive, non-transferable, revocable license to use Prism on Apple-branded devices you own or control, subject to these Terms and Apple's applicable App Store rules.
Acceptable use
You agree not to misuse Prism, interfere with the app, attempt to bypass purchase or subscription controls, reverse engineer the app, violate third-party rights, or use Prism for unlawful or abusive purposes.
User-created and saved content
You retain ownership of palettes, color selections, notes, prompts, saved moments, and other content you create in Prism. You are responsible for content you create, save, export, or share.
Prism may help you create palettes from photos, camera input, user-entered prompts, or third-party imagery. You are responsible for making sure you have the rights needed for any images or content you use or share outside the app.
Third-party content and Unsplash
Prism may include photography, inspiration, or content sourced from Unsplash or other third-party services. Third-party content remains subject to the applicable third-party terms, attribution expectations, licenses, and usage rules.
Do not remove required attribution or use third-party content in a way that violates the applicable license or service terms.
Prism Pro, subscriptions, and Remove Ads
Prism may offer Prism Pro subscriptions, Remove Ads purchases, and other paid features. Prism Pro may include benefits such as expanded palette creation, extraction, saving, ad-free use, and future premium features where available.
Remove Ads is intended to remove advertising from the free experience. Remove Ads may not include every Prism Pro feature unless the app purchase screen says otherwise.
Billing through Apple
All App Store purchases, subscriptions, renewals, billing, cancellation, Restore Purchases, and refunds are handled by Apple. Subscription price, duration, trial terms, and renewal details are shown before purchase in the app or App Store purchase sheet.
- Subscriptions automatically renew unless canceled through Apple before the renewal date.
- You can manage or cancel subscriptions in your Apple account settings.
- Use Restore Purchases in Prism to recover eligible purchases tied to your Apple ID.
- Refunds are governed by Apple's applicable policies.
Intellectual property
Prism, including its name, branding, design, interface, software, and original materials, is owned by Jesse Rubio or licensed for use and is protected by intellectual property laws. You may not copy, modify, distribute, or misuse Prism materials without permission.
App availability and feature changes
Prism may change over time. Features may be added, modified, limited, suspended, or discontinued. Some features depend on device permissions, network availability, third-party services, App Store behavior, or Apple system features.
Disclaimer of warranties
Prism is provided "as is" and "as available." Jesse Rubio does not guarantee that Prism will be uninterrupted, error-free, perfectly accurate, or suitable for every use case.
Limitation of liability
To the fullest extent permitted by law, Jesse Rubio is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, lost profits, or lost business opportunities arising from your use of Prism.
Termination
These Terms remain in effect while you use Prism. Your license may terminate automatically if you violate these Terms. Upon termination, you must stop using Prism and delete it from your devices.
Changes to these Terms
These Terms may be updated as Prism evolves. Continued use of Prism after changes become effective means you accept the updated Terms.
Governing law
These Terms are governed by the laws applicable to Jesse Rubio's residence and operations, without regard to conflict-of-law principles, unless a different rule is required by applicable consumer law.
